The orthopedic doctor says non weight bearing for 6 weeks. that will be 10-16-14. Is there a law that we can quote that will have them keep him in longer at the Rehab unit. He has medicare and Physicians mutual. We also want the insurance to pay.

Yes, secondary insurance coverage must be known. In 2014 the Medicare copay after 20 days is $152.00 per day which quickly adds up. Plans change . Make sure you know what your plan will pay! Facilities will want to discharge at 20 days if they expect resident to be self pay . Most are for profit

When my Dad was staying at a rehab facility about 6 years ago, he had to leave once he used up his time limit with Medicare.... oh he could stay on for as long as he liked, but he would have to make up the cost difference when his secondary insurance plan kicked in, and would have been over $100 per day back then.

But every case is different, and secondary insurance plans might not be all the same. You'll need to do some research.

Is he participating in physical therapy? If he's refusing, I could understand. Mom was "toe touch" for six weeks. They bicycled her legs, worked her arms, etc., etc. She had occupational and speech therapy as well. Mom was in rehab for, probably, ten weeks.

Pam's right. Demand more rehabilitation. Medicare is a stickler about rehab now. They have to be able to show progress each and every week. When the progress stops, and it's all measurable, Medicare stops paying,

Just be careful you aren't personally on the hook for his care if you refuse to take him home. Make sure they've talked Medicare into extending his coverage.

Insurance questions go to the insurance company, because they are all different. Even PM has different plans in different states and multiple levels of coverage. You tell the discharge coordinator NO you are not taking him home and you work from there. Monday mornings are when most places review cases and decide who is ready to go, who is not making progress and who can stay. Push your position, and KNOW your coverage, go online or read the book.
