My sister and I are co-guardians and were told we would need to submit an annual report. This was two years ago and we have never submitted a report and have not been contacted by the court. Will they contact me? Where can I see an example of such a report. I have no idea how to begin. Am I in contempt of court by not submitted this report?

I serve as a court volunteer for the guardianship program in the state of Texas. Guardians here are mailed forms to complete and return to the court. Volunteers provide an additional level of contact with guardians by making home visits and completing their own report. They (courts) usually want to know medical information such as changes in mental or physical health within the last year. They always need updates on doctors for the ward. They want to know the frequency of your visits (preferably once a month if the ward doesn't live with you). They inquire about activities the ward engages in (such as attending a day center or work program if possible). Of course if you handle the ward's finances you need to report to them how you've managed and spent the person's money. There's usually a generic form you complete. So, as others have advised, check with the court for a copy of the form and get busy. It doesn't have to be anything complicated, but as the guardian you do need to be more responsible and complete the reports in a timely manner. That's part of the responsibility you accepted when you became the guardian. Good luck!

In Georgia we had to file a financial report and personal (my mother's) audit at the time the guardianship/conservatorship was granted. I used them as a guide when filing each of the two years since. The court had given an instruction booklet and blank forms to be used for the future as both must be updated/refiled annually. They are also available online here. If that isn't true for your state, then contact the court to get the forms. It could be years before the court contacted you about the unfiled reports, but then you would be in contempt and the catch-up filing would be daunting and perhaps impossible to bring current. Do yourself a favor and get this done. Next year's will then also be easier. The state is less interested in the details/minutiae of the reporting than guaranteeing that your ward is being cared for and not abused in some way. Good luck! You can do this!

You are probably in contempt, but I don't think it is anything to worry about. Last year I sent in the written guardianship papers here in Iowa for my disabled son and got a notice that I was in contempt of court for not filing them on-line. I called the clerk of court and she helped me get the form on-line. I've never had to pay a fee.

When I got guardianship of my son who is developmentally disabled, my attorney gave us a template of the report that we need to fill out every year and send to the probate court to keep the guardianship current. Contact your attorney or the court that granted the guardianship for the correct form.

Call the lawyer, he should have arranged for you to get Guardian training and full certification from your state. The forms should be available online for your state. Do not delay.
