Grandma was in nursing home on Medicaid. Her social security and pension checks did not go directly to them. I would send a bank check monthly for her applied income for the previous month. My question is....Grandma passed on the 12th of the month, nursing home is telling me that we would still have to pay the full applied income for that month. But, how do they think that's possible when she won't get anymore checks?

I would be due to pay beginning of September for August applied income, but will not be receiving any more income for her. She has nothing left to pay. I did not sign any papers.

Then tell the facility that you have no money to pay, she is gone and they are out of luck.

I bet that you could trace this back and find that they have been paid, I know of no facility that will accept payment in the rears. They want their money up front. But be that as it is, you are not responsible to pay them as you never signed a contract.

If they try to harrass you for the money, tell them that you will be filing a complaint against their licensing and a police report for threats and intimidation because their harrassment is causing you anxiety. You do not have to put up with them at this point, so don't.

I'm sorry about your Grandma. Do you have the contract with NH?
If you do, look for the section that states what happens with the death of the resident.

In most if not all cases, the contract terminates when the resident dies. The only charge they could charge you is the day (s) her stuff is still in the room after the 12. They can take on another resident before the month's end and charge them the day they move in.

What this NH is probably trying to do is treat her like she was renting an apartment. Good luck.

Didn't you already pay them for that month? Usually rent is due at the beginning of the month and social security is a month in the rears, so she gets the check say for June in July, but July 1st was paid with the check received in June. Is that not how you pay them?

They usually do expect to be paid for the entire month, but who are they going to collect against if she doesn't have an estate and she is dead? Did you sign to be personally responsible?

I am sorry for your loss. I hope that you get this sorted out.
