I am named the Durable POA and I am also named as Trustee if my parent becomes incapacitated. All assets and accounts are in the Trust, so I'm not sure when the Durable POA would be used. I am not acting as POA or Trustee at this time.

POA allows you to sign things for them when they can't. ALWAYS sign POA after your name when signing for them at the hospital or MD. Trustee, means you manage the trust, so then you sign your name and write "Trustee" when signing as the Trustee. That eliminates confusion and keeps you from being personally responsible for their bills. This is really important if a Nursing Home is involved. They told my husband he did not have to write POA after his name. I almost flew across the table "READ MY LIPS" I said "ALWAYS WRITE POA AFTER YOUR NAME". So he wrote POA on the form.
