I am new to SSI and reporting every change in X amount of time. About seven weeks ago, unfortunately my father died and left an inheritance that I received from his VA benefits. I hadn't reported yet, only because I have been so wrapped up in everything involving my father's passing, because he did live with us, so there was much more involved. Yesterday, my at home Nurse asked me if it was going to mess up my Medicaid? Not only was I stumped, but I had not even thought anything about that part yet. So now I have to act quick. Have found out that I need some sort of trust, fast or is making one now a moot point? Help. I would like to contact Mr. Gabriel Heiser but I don't know how to do that from here. Any answers to the trust/Medicaid dilemma or how to contact Atty. G. Heiser would be greatly appreciated.

Contact an elder law attorney in your state who can help you with Medicaid issues in your state. GHeiser is an author and attorney. I doubt that he provides consultations via email or phone.

Thankyou for your help, but I have mostly been told there aren't any in my area, or state, so I am figuring I will have to do a phone consultation either way. But thanks for saving me a little time looking.

Medicaid compliant special needs trust
or
if your disability is from something before age 25/27 maybe an ABLE account.
How creative to me depends on the amount of $. But whatever is done is not a DIY, I’d suggest you get with a disability law atty.

Call your office on Aging. See if they can give you a list of Lawyers that charge on scale. The lawyer that set up a Special needs trust for my Nephew was a SS lawyer. Depending on the amt you received, his fees can come from the inheritance. I would not wait. The eoy is approaching. This is when Medicaid requests bank statements. Your inheritance will show and could disqualify you. This includes your SSI.

The Medicaid rule(s) need to be upgraded - especially along the lines of SSI - $2,000 threshold is not suffice for any person - it's set to impoverished people - the A.B.L.E. Act was spoken about, but that too - although helpful - currently has the age restriction of under 26 for disability discovery ... the SSI Restoration Act currently in Congress - since 2010???? - would allow SSI / Medicaid folks to have a decent amount of basic savings up to $10, 000 ... and would abolish the terrible and foolish IN-Kind Support & Maintenance Rule that would cut your lowly SSI check in thirds if you even receive some food or basic shelter from anyone - how terribly outrageous - get to know the issues and vote for those who want to help Disabled & Poor Elderly!!

*** Most people on Medicaid SSI have and still pay some form of taxes ... usually before illnesses, Aging, Death, Disabilities - there needs to be a more humane and rational application to treating our sick and poor elderly fairly!!!!

+++ I would be in favor of placing a small fee (VAT) on all purchases via the Internet ( putting Brick & Mortar Stores out-of-business, laying-off workers. effecting Property Vales) and apply that to a 'restrictive' Health Care Account to subsidize the Medicaid / Medicare Funding System!!!

My nephew has SSD. He receives Medicare and Medicaid. He has always had an average of 5k in his bank acct. He is on workability and is allowed to make 30k a year. He doesn't make that much and SSD may not allow it but he can.

You'd do yourself a favor by hiring an elder law attorney.

I agree that you need to Google elder attorney in your area, AND definitely Google Council on Aging for your county. COA is there for these sorts of issues.

I think the Trust, if you need one, is a Miller trust, but it may be that is not available for you, as the money is from a VA pension.

Thsnkyou for the helpful answer. I realize I was looking for my keys words to be ,"trusts" and "Medicaid" as their specialties and as soon as I started with "Elder care" much more opened up to me
And I've already found and hired one. Thanks for pointing me in the right direction.

Sorry to hear about your dads passing. Just a thought here ... You might look into an ABLE account. Not sure if that would work but if it does it's a lot less of a hassle and expense to just open an account! You have to have been disabled before age 26 to qualify but just thought I'd mention it.

It depends on how big your inheritance is. Also, it's illegal to hide assets just so you can appear to qualify for a low income government assistance program.
