My mother in law just recently passed away On April 17 at an assisted living center. Because we did not give 30 days notice that she would be leaving her apartment, we will be responsible for her apartment rental until May 17. Does anyone know if this apartment can be rented to a new resident before May 17 or is it considered hers until then? If they do rent it out before May 17, is that considered legal?

Considering the pandemic, it’s highly unlikely the apartment will be rented before May 17th. You need to read the agreement that was signed when she became a resident of the AL. She has to pay the entire month of May.

I agree with Mac. I don't think the 30days come into effect if the person dies. But if it does, no, if you pay rent up to a certain time, the room is still Mom's, it can't be rented. Just like any other apartment.
