My mom lives in Oregon, has incurable cancer. I am moving her this week to my house. She has signed a Durable POA. Put my name on her accts put a will together, but is not signed-she owns mobile home and I don't know if I should leave it in her name or transfer it to my name now. Its only worth maybe $5000.

If the cancer is incurable then it's time to get all the affairs in order.......finish the will & get it signed & notorized also.

If there is no plan to apply for public benefits then by all means go ahead and transfer now....or even better, sell it (unless, of course, you plan on keeping it as a vacation spot!).

If you will be applying for benefits I would recommend against transferring now as that would considered an uncompensated transfer. It is true that at her demise the mobile home will be a part of her probate assets which will be a problem if it is in another state.

It is difficult to avoid probate with a mobile home because it is not real property and cannot be titled in the name of a trust.

In any event, the best course of action is to dump the thing and concentrate on taking care of mom.

So sorry about your Mom and bless you for taking her in! If you dont have her home in a trust, and she passes, it will go into probate . This means the house isnt in your name and you will have to go thru the courts to put it in your name, costing you money and a long process. Sell or buy the home and use it for her care, thats all you can do, If you dont, medicaid will put a lein on it and take it if you get medicaid help anyway. (in my State this is the case anyway) and thats what we did. We got a caretakers agreement drawn up and the money goes to daycare, her care, my caring , etc, until its gone, then we can apply for medicaid. You have to see a lawyer right away, they know all the ropes, Hugs 2U

You need to get the home signed over to you as soon as possible. There will many medical coming up and you do not need a lein placed on her home. You even setup a pre paid buriel account, i know this may sound sad, but it helps out when the time comes. I went through a lot with my mom, she had dementia and other medical problems. She made me durable power of attorney however would never place my name on the house. In new York placed a lein on the house. Take care, you have most of the paper work, also set up that you are personal rep with her banking account, it is easier than POA account. Take care .
